Administrative Monetary Penalty System (AMPS)

The Administrative Monetary Penalty System (AMPS) is a municipally administered program that is designed to offer a faster, more flexible and customer focused adjudication process for Designated By-law offences. The process transfers disputes of lesser By-law charges from the provincial offences courts to the municipality, while still allowing for more serious By-law offences to be processed by the Courts.

This approach is used by many municipalities, the province and the federal government and is designed to streamline the enforcement process and increase compliance with Township of Selwyn By-laws.

Cash, debit and cheque payments can be made at the Selwyn Township Municipal Office.

Any person who is served with a Penalty Notice may request that the Penalty be reviewed by a Screening Officer on or before the date on which the Penalty is due and payable.

Please Note: Pursuant to section 8(3) of Ontario Regulation 333/07 made under the Municipal Act, 2001, S.O. 2001, c. 25, neither a screening officer nor a hearing officer has jurisdiction to consider questions relating to the validity of a statute, regulation or by-law or the constitutional applicability or operability of any statute, regulation or By-law.

FAQ's

AMPS are a progressive enforcement tool used by many municipalities, the province, and the federal government to address pressure on municipal resources and court backlogs.

In Ontario, Municipal AMPS are legislated under the Municipal Act, 2001 and Ontario Regulation 333/07, which establishes the requirements for parking-related AMPS. Section 434.1 of the Municipal Act, 2001 was enacted by the province in 2017 and allows municipalities to impose AMPS for almost any municipal By-law.

The system is designed to help over-burdened courts by allowing municipalities to handle minor Designated By-law offences.

AMPS are more effective in several ways:

  • A typical Provincial Offences Act process takes from 6 months to a year, whereas AMPS are processed within a matter of weeks to months while still providing a procedurally fair, transparent and accessible process.
  •   AMPS allows the Township to manage disputes internally instead of through the provincial offences court
  •  Penalty amounts are not punitive in nature; rather, they are set at a level reasonably required to promote compliance with a designated By-law.

AMPS Penalty Notices (“tickets”) can be issued by:

  • Municipal By-law Enforcement Officers appointed by Council to enforce the Township’s By-laws
  • a Provincial Offences Officers appointed by Council to enforce the Township’s By-laws
  •  Property Standards Officers appointed by Council to enforce the Township’s By-laws
  • The Chief Building Official for the Township
  • Building Inspectors
  • Police officers employed by the Peterborough Police Service (Village of Lakefield) or the Ontario Provincial Police (Smith and Ennismore Wards)

Penalty Notices can be issued through the following methods:

  • In person
  • Placing or affixing to a person’s vehicle
  • Registered Mail to the person’s last known address
  • By facsimile (fax) to a person’s last known facsimile transmission number
  • Email to the person’s last known email address

Please Note: Parking-related Penalty Notices are generally issued by attaching the notice to the vehicle or serving the notice directly to the operator; however, they may also be issued through any methods noted above.

A Review by a Hearing Officer is a quasi-judicial review of the Screening Decision by an independent Hearing Officer appointed by Council for the Township of Selwyn. Reviews are governed by the Statutory Powers Procedure Act, Township By-laws, and the balance of probabilities (civil standard of proof). 

After a Review by a Hearing Officer, the Hearing Officer will deliver a Hearing Decision affirming the Screening Decision, reducing the Administrative Penalty or cancelling the Administrative Penalty.

The decision of a Hearing Officer is final and is not subject to any further review, including by any court.

There is no fee for obtaining a review by a Screening Officer or a Hearing Officer; however, an administrative fee may be applied in respect of the failure of a person to appear at the time and place scheduled for a review by a Screening Officer or a Hearing Officer.

The administrative fee(s) may be added to the Administrative Penalty and become due and payable to the Township.

In certain cases, additional administrative fees may be applied to the original penalty amount:

Please Note: The Fee Amount for Administrative Fees listed above does not include Harmonized Sales Tax (H.S.T.).

If an Administrative Penalty, and any associated Administrative Fee(s), is not paid within 15 days after the date that it becomes due and payable, the Township has the right to enforce payment of the amount in default by:

  • charging late payment fees 
  • charging fees to obtain documents or information on a vehicle or owner of a vehicle 
  • filing a certificate of default in a court of competent jurisdiction
  • notifying the Registrar of Motor Vehicles to deny renewal of a vehicle licence plate until the penalty is paid (only applies to parking offences)
  • adding the administrative penalty to the tax roll for any property in the Township for which all of the owners are responsible for paying the administrative penalty, and collect it in the same manner as municipal taxes

The Parking By-law is the Township’s first By-law designated under AMPS. More By-laws may be designated, as necessary.
